Prohibited Items Policy

This Prohibited Items Policy lists goods and services that may not be listed, requested, promoted, or transacted through WPARTS. It is incorporated into the Terms of Service, the Seller Agreement, and the Acceptable Use Policy. If a translation conflicts with the English version, the English version controls. Nothing in this Policy limits non-waivable rights that apply to you under the law of your country or state of residence.

WPARTS may remove listings, cancel Order routing, suspend hosted sites, and terminate accounts. This list is not exhaustive. If an item is illegal where you or the Buyer is located, you must not list or request it even if it is not named below.

1. Stolen, Fraudulent, and Unauthorized Goods

  • Stolen parts, vehicles, or accessories, or goods you do not have the legal right to sell;
  • Counterfeit, replica, or falsely branded OEM or aftermarket parts (see the Intellectual Property & Counterfeit Policy);
  • VIN plates, title documents, or identity documents offered for fraudulent use;
  • Goods obtained by fraud or from a sanctioned source.

2. Safety-Critical and Recalled Parts

  • Airbags and airbag components that are used, salvaged, or subject to recall, and any airbag listing that applicable law (including U.S. federal or state law) prohibits or restricts. Do not list recalled inflators or modules that must be destroyed or returned under a recall;
  • Parts subject to an open safety recall that are unsafe to install, unless the Listing clearly states the recall status and the sale is lawful;
  • Other recalled or condemned parts that pose an unreasonable risk of injury or vehicle failure.

Sellers must not list parts they know are recalled and unsafe. If a recall is announced after listing, the Seller must remove or update the Listing and notify affected Buyers.

3. Catalytic Converters and Emissions Parts

  • Catalytic converters, diesel particulate filters, or similar emissions components where sale, purchase, or possession is restricted or prohibited by applicable law (including state laws that restrict used catalytic converters or require documented proof of ownership);
  • Defeat devices, aftermarket products marketed to disable required emissions controls, or parts whose sale would violate the Clean Air Act or equivalent rules.

Where a used converter may lawfully be sold, the Seller must comply with recordkeeping, identification, and buyer-verification rules in the relevant jurisdiction. If you cannot comply, do not list the item.

4. Hazardous Materials

  • Hazardous materials that require special licensing or that common carriers will not accept without undeclared dangerous-goods shipping (for example, undeclared explosives, certain compressed gases, bulk asbestos, or unlabeled toxic chemicals);
  • Radioactive materials;
  • Used chemicals, waste oil, or other waste offered in violation of environmental law.

Ordinary automotive fluids in retail consumer packaging may be listed only if shipment and sale are lawful and the Listing discloses hazards. When in doubt, do not list.

  • Firearms, firearm frames or receivers, ammunition, explosives, and destructive devices;
  • Weapon parts or kits that are illegal to transfer without a license;
  • Switchblades, illegal knives, or other weapons prohibited in the relevant jurisdiction;
  • Instructions whose primary purpose is to build illegal weapons or explosives.

Ordinary hand tools and legal sporting goods are not prohibited solely because they could be misused.

6. Drugs and Drug Paraphernalia

  • Controlled substances, illegal drugs, and prescription drugs offered without a lawful pharmacy authorization;
  • Drug paraphernalia marketed for illegal use;
  • Nitrous oxide or other substances marketed for recreational inhalation in violation of law.

Legal over-the-counter auto-care chemicals sold for their labeled automotive use are not, by that fact alone, prohibited.

7. Child Sexual Abuse Material and Sexual Content Involving Minors

Any child sexual abuse material, or any sexual, pornographic, or exploitative content involving minors, is strictly prohibited. See the Acceptable Use Policy. WPARTS will remove the content, terminate the account, and report as required by law.

8. Sanctions and Export-Controlled Items

  • Items you may not export or re-export under U.S. or other applicable export-control or sanctions law;
  • Dealings with sanctioned persons, entities, or comprehensively sanctioned jurisdictions;
  • Military or dual-use items that require a license you do not have.

9. Services and Listings We Do Not Allow

  • Listings that are solely a scam, phishing page, or malware distribution;
  • Medical devices or implants that may not be sold without authorization;
  • Human remains or body parts (other than lawfully sold hair products, which are outside this automotive marketplace in any event);
  • Live animals.

10. Restricted Automotive Items (Allowed Only If Lawful and Accurately Described)

The following may be listed only if the sale is lawful, the condition is accurate, and required warnings are given:

  • Used, remanufactured, or core-charge parts (disclose condition and core terms);
  • Parts that require professional installation (state that clearly);
  • Items requiring California Proposition 65 or other chemical warnings (Seller must provide the warning on the Listing and hosted site).

11. Enforcement and Questions

WPARTS may remove a Listing or request without prior notice if we believe it violates this Policy or the law. Questions: legal@wparts.com.
