This Intellectual Property & Counterfeit Policy (“IP Policy”) explains how WPARTS LLC (“WPARTS”, “we”, “us”, or “our”) handles trademark, counterfeit, and other non-copyright intellectual property complaints, and what Sellers must warrant. Copyright complaints must follow the DMCA Policy. This Policy is incorporated into the Terms of Service and the Seller Agreement. If a translation conflicts with the English version, the English version controls.

1. Respect for Intellectual Property

WPARTS respects the intellectual property rights of brand owners, manufacturers, photographers, and other rights holders. Sellers may not list, advertise, or fulfill counterfeit, pirated, or unauthorized branded goods. Buyers should report suspected counterfeits. WPARTS does not manufacture or authenticate parts and relies on Seller warranties and rights-holder notices.

2. Seller Warranties

By listing a product or publishing a hosted site, the Seller represents, warrants, and covenants that:

the Seller has the right to sell the goods and to use all brands, logos, part numbers, photographs, and text in the Listing and on the hosted site;
the goods are authentic and genuine as described, and are not counterfeit, replica, or falsely branded OEM or aftermarket parts;
if the Seller uses an OEM brand name or part number for fitment or interchange, the use is truthful (for example, “fits [OEM part number]” or “aftermarket equivalent”) and does not imply that the Seller is the brand owner or an authorized dealer unless that is true;
photographs depict the actual item or are clearly identified as stock or catalog images the Seller is licensed to use;
AI-generated listing or site copy has been reviewed by the Seller for accuracy and IP compliance before publishing.

Nominative fair use of a brand to describe compatibility is allowed when it is accurate and not confusing as to source. Using a brand owner’s logo or “official” badges without authorization is not allowed.

3. Counterfeit OEM and Aftermarket Parts

Counterfeit parts include goods that copy a brand’s mark, trade dress, packaging, or holograms in a way likely to confuse a buyer as to source, or that are sold as OEM when they are not. Listing counterfeit airbags, electronics, braking components, or other safety parts is also a prohibited item and a safety violation.

WPARTS may remove suspected counterfeit listings, require proof of authenticity (invoices from authorized distributors, photographs of markings), suspend the Seller, and notify rights holders or law enforcement. WPARTS is not obligated to test parts in a laboratory.

4. Notice-and-Takedown (Non-Copyright)

Rights holders may submit a trademark, counterfeit, design-patent, or other IP complaint that is not a DMCA copyright notice. A useful complaint includes:

The rights holder’s name and contact email;
Identification of the trademark, patent, or other right (registration number if any, or a clear description);
The URL of each Listing, image, or hosted page;
A description of why the material infringes or is counterfeit;
A good-faith statement that the use is not authorized;
A statement that the information is accurate and that you are the rights holder or an authorized agent;
A physical or electronic signature.

WPARTS will review in good faith and may remove or disable the material, notify the Seller, and request a response. This process is a platform policy, not a statutory safe harbor. For copyright, you must use the DMCA elements.

5. Seller Response

A Seller whose Listing is removed may email legal@wparts.com with evidence of authenticity or authorization (invoices, licenses, photographs of markings). WPARTS may restore, keep the Listing down, or terminate the account. Repeat counterfeit listings may result in immediate termination.

6. WPARTS Brand

You may not use the WPARTS name, logo, or trade dress in a way that suggests sponsorship or that WPARTS is the seller of your goods, except for factual statements that you list on or use the WPARTS platform. You may not register domains or social handles that impersonate WPARTS.
